PRIVACY POLICY


1. IN GENERAL

1.1. The concept of the jkbapp.com platform is based in part on the publication of details regarding individual users by making such details accessible to other users via the jkbapp.com platform.

1.1.1. The collection, administration and use of personal details by jkbapp complies with applicable data protection laws by ensuring that each user is able to decide herself, which personal details shall be made accessible to other users.

1.1.2. Special notice regarding the „Live Tracking“-feature: The jkbapp.com platform includes a "Live Tracking"-feature, which, if activated by a user in her own discretion, enables third parties to see the route and data of such user's sports activity on the jkbapp.com platform. Unless disabled by the user in the profile settings, such user will be queried prior to each session whether she wants to activate the feature for such session. Activation of the "Live Tracking"-feature is entirely voluntary. By activating the feature, the user accepts the responsibility for such activation at her own risk. If the user does not want to give third parties access to her training route and data, then the "Live Tracking"-feature should not be activated. The user's privacy settings can be configured accordingly, via Profiles-Setting-Privacy.

2. CATEGORIES OF PERSONALLY IDENTIFIABLE INFORMATION COLLECTED BY jkbapp

2.1. When you Use the Software & Services, we automatically collect and store the following types of information:

  1. User Provided Data.  Each Application obtains information that you provide when you download and register the Application.  Registration with us is optional.  However, please keep in mind that you may not be able to use some of the features offered by the Applications unless you register with us.  When you register with us and/or use an Application, you generally provide (a) your name, email address, and other registration information; (b) your age and gender; (c) information you provide us when you contact us for help; and (d) information that is entered into our system when you use the Applications, such as your heart rate data (“User Provided Data”).  We may also use the information that you provide to us to contact you from time to time to provide you with important information, required notices and marketing promotions.
  2. Automatically Collected Data.  In addition, the Application may collect certain information automatically, such as the type of mobile device you use, your mobile device’s unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, and information about the way you use the Application. The Application does collect precise information about the location of your mobile device. We may also use Cookies and navigational data like Uniform Resource Locators (“URL(s)”) to gather information regarding the date and time of your visit and the solutions and information for which you searched and which you viewed.  “Cookies” are small pieces of information that a website sends to your smart phone while you are viewing a website.  We may use both session Cookies (which expire once you close your browser) and persistent Cookies (which stay on your smart phone until you delete them) to provide you with a more personal and interactive experience on our Sites.  If you choose to disable Cookies, our Applications may not work properly.  Like most companies, we automatically gather the information described above (“Automatically Collected Data”) and store it in log files each time you use the Applications.
  3. Information Collected from Third Party Companies.  We may receive Personal and/or Anonymous Data about you from companies that provide our Applications by way of a co-branded or private-labeled website or companies that advertise their products and/or services through our Applications.  These third party companies may supply us with Personal Data,.  We may add this information to the information we have already collected from you.
  4. Information Collected from Social Networking Sites.  Our Applications may collect Personal and/or Anonymous Data about you from a social networking site (“SNS”), in accordance with the terms of use and privacy policy of the third party provider of such SNS, if you log on with your login credentials from the SNS. We may add this information to the information we have already collected from you.
  5. Camera : iCare determines your PPG and heart rate from a distance by using the camera sensor within your phone.
  6. microphone : iCare determines your lung capacity and breath rate from a distance by using the microphone sensor within your phone.
How the Company Uses Your Information.

The Company uses the information it collects for analytical, business and operational purposes in the following ways:

1. to operate and update the Software & Services and provide you with existing and new functionality and features;

2. to improve and customize the Software & Services;

3. to provide you personalized content, including through the delivery of targeted interest-based advertisements from us or our partners;

4. to maintain and improve the quality and operation of the Software & Services;

5. to notify you of Software & Services updates;

6. to provide you with support and handle your complaints and/or feedback;

7. to take any action in case of a dispute involving you in connection with the Software & Services;

8. to enforce the terms and conditions applicable to the Software & Services and to prevent unlawful activities and misuse thereof;

9. to comply and satisfy any applicable law regulation, legal process or enforceable governmental request.

Sharing Information with Third Parties.

We may share with third parties the information collected in any of the following events:

1. If we are required by law to disclose your information, we may share your information with law enforcement or other competent authorities and any third party, as may be required (e.g., to detect, prevent or otherwise address fraud, security, or technical issues; to respond to claims or satisfy any legal process, subpoena, or governmental request; or to protect the rights, property, or personal safety of the Company’s users, its partners, or the general public);

2. In the event the Company goes through a business transition such as a merger or acquisition by another company, consolidation, change of control, reorganization, or sale of all or a portion of its assets, your information will be among the assets transferred;

3. We may share your information with certain third parties (including, without limitation, search engines, content providers, and advertising networks and platforms) that provide various services (such as advertising, marketing, analysis, content, and search) in connection with the Software & Services. We take appropriate measures to ensure that no user can be individually identified from the disclosure of such information, and we require these third parties (i) to keep the data secured, (ii) not to use the data for any other purpose other than to provide us with services, and (iii) to use the data solely in compliance with this Privacy Policy;

4. We may also share PII and non-personally identifiable information with our subsidiaries, affiliated and parent companies but their use of such information must comply with this Privacy Policy. In any case other than the above, we will not share your PII with third parties without your prior consent.

 

3. PRIVACY SETTINGS

3.1. Every user can change the privacy settings applicable to her account. In this way, the user can

3.1.1. decide, to a certain extent, which personally identifiable information is collected with respect to such user; and

3.1.2. define who can see personally identifiable information that is collected (see below, Item 3.2).

3.2. With respect to the following details, each user can decide, via Profiles-Setting-Privacy, who can see such information: 1. Profile data 2. Activities 3. Status feed 4. Maps of sport-sessions 5. Tracks 6. Photos 7. Sports statistics. The different settings that are available are as follows:

3.2.1. All: Everyone will be able to see this, regardless of whether they have an account or not.

3.2.2. All logged in users: All logged in jkbapp users will be able to see this.

3.2.3. Friends of Friends: Only your friends, as well as their friends will be able to see this.

3.2.4. Friends: Only your friends will be able to see this.

3.2.5. None: Nobody will be able to see this.

4. USE AND SHARING OF PERSONALLY IDENTIFIABLE AND NON-PERSONALLY IDENTIFIABLE INFORMATION WITH THIRD PARTIES

4.1. By registering, the user explicitly agrees that jkbapp shall have the right to use all automatically collected personally identifiable information, in accordance with the privacy settings of such user, for purposes of the jkbapp applications. jkbapp does not pass on personally identifiable information (see Section 2, above) to third parties, except as required by law or with the explicit consent of the user. jkbapp implements all reasonable measures to prevent the unauthorized access by third parties to saved details.

4.2. The user explicitly consents to the storage and use of non-personally identifiable information for purposes of in-app advertising or on www.jkbapp.com by jkbapp or its partners.

4.3. Health data will never be shared with advertisers or similar agencies.

5. PLUGINS AND WIDGETS FOR SOCIAL MEDIA

5.1. The jkbapp.com Platform includes social media plugins, such as (i) Facebook, 1601 South California Avenue, Palo Alto, CA 94304, USA; (ii) Google +, 1600 Amphitheatre Parkway, Mountain View, CA 94043; or (iii) Twitter, 1355 Market Street, Suite 900, San Francisco, CA 94103, USA.

5.2. Such plugins can recognize a user’s IP address and the page visited on the jkbapp.com platform, and, possibly, store cookies, so that the services offered by jkbapp work properly. Social media plugins and widgets are hosted either by third party providers or directly by us. Your interactions with these plugins are subject to this privacy policy or the privacy policy of any third party that offers such feature. jkbapp is not responsible for the use of, or guidelines regarding the use of, personal data by third party providers.

5.3. Users may recognize the respective plugins, e.g., by the respective logo or other respective characteristic typical for the respective social media-platform on our pages. 5.4. If a user interacts with the plugins, e. g. by clicking on the Facebook "Like-Button" or entering a comment, while being logged in to such user's Social Media-account on Facebook, Google+ or Twitter, a user links the contents of the jkbapp pages to her respective social media-profile. Thereby, Facebook/Google+/Twitter can associate a user's visit of the jkbapp page with such user's social media-account. jkbapp as the provider of the jkbapp.com platform does not have any knowledge of the content of the transmitted data or its usage by Facebook, Google+ or Twitter. 5.5. If users do not want to have the respective social media-platform associate their visits on our site with their social media-account, users must log out from their social media-account.

6. COOKIES

6.1. Several areas of the jkbapp website use 'cookies' ─ small text files that are placed on the user's computer and stored by the browser. They are used by jkbapp to provide a more user-friendly, effective and secure service. Cookies also enable jkbapp to identify a user's browser and offer services to such user. Cookies do not contain any personally identifiable information.

6.2. You can prevent the installation of cookies by entering the corresponding settings in your browser software. However, please note that in this case you may not be able to use the complete range of functions of the jkbapp.com platform to its full extent.

7. GOOGLE ANALYTICS

7.1. The jkbapp.com platform uses Google Analytics, a web analysis service by Google Inc. ("Google"). Google Analytics uses 'cookies' (see Section 6, above). The information about your visit collected by the cookies, including your IP address, is usually transferred to a Google server in the USA and saved there. To the extent that the jkbapp.com platform has activated IP anonymization, Google first abbreviates your IP address within member states of the European Union or in other signatory states of the Agreement on the European Economic Area. Only in exceptional cases, will the full IP address be transferred to a Google server in the USA and abbreviated there. Google will use the information collected on behalf of the website operator to evaluate your use of the jkbapp.com platform, to compile reports about your activities within the jkbapp.com platform, and to provide further services to jkbapp related to use of the jkbapp.com platform and Internet use. Google will under no circumstances associate the IP address transmitted by your browser within the operations of Google Analytics with other Google data.

7.2. The jkbapp.com platform expanded the Google Analytics-Service with the “anonymizeIP”-Code to anonymize the user’s IP-address.

7.4 The jkbapp.com platform uses Google DoubleClick for Publishers (“DFP”). DFP uses Cookies to provide the user with user-relevant advertisements – further information may be found at https://support.google.com/dfp_premium/answer/2839090?hl=en. The user may disable the DFP’s cookie placement and the placement of user-relevant advertisements via the website: http://www.google.com/ads/preferences.

8. CHANGES TO PRIVACY POLICY

8.1. If jkbapp decides to change its privacy policy, it will post those changes on this page.
